Stony Peak Construction Ltd. Terms and Conditions
These Terms and Conditions ("Terms") govern the provision of construction services by Stony Peak Construction Ltd. ("Stony Peak Construction," "we," "us," or "our") to you ("Client," "you," or "your"). By engaging our services, you agree to be bound by these Terms.
1. Scope of Services
Stony Peak Construction will provide construction services as outlined in the applicable Contract Agreement ("Agreement"). The scope of work, timelines, and pricing are subject to the terms of the Agreement.
2. Client Responsibilities

Site Access: Client shall provide safe and unobstructed access to the project site for Stony Peak Construction and its subcontractors.

Utilities: Client shall be responsible for ensuring the availability of necessary utilities, such as water and electricity, at the project site.

Permits and Approvals: Client shall be responsible for obtaining all necessary permits and approvals from relevant authorities.

Cooperation: Client shall cooperate fully with Stony Peak Construction throughout the project, including providing timely information and approvals.
3. Payment Terms
Payment terms are outlined in the Agreement. Late payments may be subject to interest charges as specified in the Agreement.
4. Warranty
Stony Peak Construction warrants that its work will be performed in a professional and workmanlike manner, in accordance with industry standards and applicable building codes. This warranty does not cover normal wear and tear, damage caused by third parties, or defects arising from Client-supplied materials.
5. Limitation of Liability
In no event shall Stony Peak Construction be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of use, or business interruption, arising out of or related to the performance or non-performance of these Terms or the Agreement, even if advised of the possibility of such damages.
6. Dispute Resolution
Any disputes arising out of or relating to these Terms or the Agreement shall be resolved through good faith negotiation. If the parties are unable to resolve the dispute through negotiation, they may resort to binding arbitration in accordance with the applicable rules of the [Specify Arbitration Institution, e.g., American Arbitration Association].
7. Governing Law
These Terms and the Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada.
8. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
9. Entire Agreement
These Terms and the Agreement constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
10. Amendments
These Terms may be amended from time to time by Stony Peak Construction. Any amendments will be effective upon posting on our website or upon written notice to Client.
